dc.description.abstract	ดุษฎีนิพนธ์ฉบับนี้มุ่งที่จะศึกษาอนุสัญญาว่าด้วยพื้นที่ชุ่มน้ำที่มีความสำคัญระหว่างประเทศ โดยเฉพาะเป็นแหล่งที่อยู่อาศัยของนกน้ำ อนุสัญญาฉบับนี้เกี่ยวกับการจัดการและการอนุรักษ์พื้นที่ชุ่มน้ำทั่วโลก ในปัจจุบันอนุสัญญาฉบับนี้มี 172 รัฐภาคี รวมทั้งประเทศไทย อนุสัญญาฉบับนี้ได้กำหนดพันธรณีที่มุ่งต่อผลเอาไว้ ในทางปฏิบัติจึงทาให้รัฐภาคีสามารถดำเนินการต่าง ๆ ได้อย่างยืดหยุ่น นอกจากนี้ อนุสัญญาฉบับนี้มีแนวปฏิบัติซึ่งประกอบด้วยแนวคิดหลายประการเพื่อการจัดการและการอนุรักษ์พื้นที่ชุ่มน้ำ เช่น การใช้พื้นที่ชุ่มน้ำอย่างชาญฉลาด (ยั่งยืน) การธำรงความสมดุลระหว่างการพัฒนาและการอนุรักษ์พื้นที่ชุ่มน้ำ การมีส่วนร่วมอย่างแท้จริงของประชาชนในการจัดการและการอนุรักษ์พื้นที่ชุ่มน้ำ และอื่น ๆ อย่างไรก็ดี รัฐภาคีได้นำแนวปฏิบัตินี้ไปใช้ต่างกัน รัฐภาคีส่วนใหญ่ รวมทั้งประเทศไทย ได้นำแนวปฏิบัตินี้ไปใช้ในฐานะที่เป็นส่วนหนึ่งของมาตรการอนุรักษ์สิ่งแวดล้อมทั่วไปของตน ดังนั้น การนำแนวปฏิบัตินี้ไปใช้จริงโดยรัฐภาคีจึงเป็นส่วน ๆ และต่างกันด้วยเหตุดังกล่าว ดุษฎีนิพนธ์ฉบับนี้จึงพยายามที่จะค้นหาปัญหากฎหมายที่เกี่ยวกับนำแนวปฏิบัตินี้ไปใช้จริงโดยรัฐภาคี และที่จะเสนอแนะวิธีแก้ปัญหาต่อรัฐบาลไทย	en_US

dc.description.other-abstract	This dissertation aims at studying the Convention on Wetlands of International Importance especially as Waterfowl Habitat. This convention concerns management and conservation of wetlands around the world. This convention now has 172 contracting parties, including Thailand. This Convention has established the obligation of result which in practice allows the contracting parties to operate flexibly. In addition, this convention has a guideline which comprises several concepts for management and conservation of the wetlands, such as wise (sustainable) use of the wetlands; maintaining equilibrium between the development and conservation of the wetlands; genuine public participation in the management and conservation of the wetlands, and so on. Nevertheless, the contracting parties has employed this guideline differently. Most of the contracting parties, including Thailand, have employed this guideline as a part of their general environmental measures. Therefore, the actual employments of this guideline by the contracting parties are piecemeal and discrepant. Consequently, this dissertation attempts to find out legal issues relating to the actual employments of this guideline by the contracting parties, and to recommend solutions to the government of Thailand	en_US
