| Abstract: | วิจัยเรื่องนี้ เป็นการวิจัยเชิงคุณภาพ มีวัตถุประสงค์ (1) เพื่อศึกษาถึงความเป็นมา งานวิจัย ที่เกี่ยวข้อง แนวคิดทฤษฎี เกี่ยวกับกฎหมายประกันภัยสัตว์เลี้ยงภาคบังคับ สภาพกฎหมายและปัญหา ของประกันภัยสัตว์เลี้ยงภาคบังคับ (2) เพื่อศึกษาเปรียบเทียบกฎหมายของต่างประเทศเกี่ยวกับ การประกันภัยสัตว์เลี้ยงภาคบังคับและวิเคราะห์ถึงแนวคิดของกฎหมายของต่างประเทศและมาตรการ อื่น ๆ ในต่างประเทศของการประกันภัยสัตว์เลี้ยงภาคบังคับ (3) เพื่อวิเคราะห์มาตรการทางกฎหมาย เกี่ยวกับการประกันวินาศภัยสัตว์เลี้ยง (4) เพื่อเสนอแนะแนวทางในการพัฒนาปรับปรุงมาตรการ ทางการประกันภัยให้มีการบังคับใช้ได้อย่างเหมาะสมอย่างมีประสิทธิภาพและสัมฤทธิ์ผลยิ่งขึ้น จากการศึกษาพบว่า กฎหมายประกันของไทยยังไม่มีนิยามคำว่า”สัตว์เลี้ยง” เมื่อเปรียบเทียบกับ ต่างประเทศ และตามทฤษฎีส่วนได้เสียในการทำประกันภัยสัตว์เลี้ยง ยังไม่มีพื้นฐานของเงื่อนไข การทำประกันสัตว์เลี้ยง ความคุ้มครองตามกรมธรรม์ประกันภัยสัตว์เลี้ยงให้มีรายละเอียดที่ชัดเจน การคิดอัตราเบี้ยประกันภัยสัตว์เลี้ยง การทำประกันภัยภาคบังคับสัตว์เลี้ยงที่ต้องทำกับภาคสมัครใจที่มี ส่วนเพิ่มเติม ตลอดทั้งความรับผิดของผู้ฝ่าฝืนที่ไม่ทำประกันสัตว์เลี้ยงเมื่อเปรียบเทียบกับของ ต่างประเทศ จากผลการศึกษาจึงมีข้อเสนอแนะ ดังนี้ (1) ให้มีการนิยามคำว่า “สัตว์เลี้ยง” ใน พระราชบัญญัติป้องกันการทารุณกรรมและการจัดสวัสดิภาพสัตว์พ.ศ. 2557 (2) นำกฎหมายของ สหรัฐอเมริกามาปรับใช้ (3) ให้มีการกำหนดรายละเอียดโดยแบ่งรายละเอียดออกเป็นการประกันสุขภาพของสัตว์เลี้ยงและการจ่ายค่าสินไหมทดแทนหากสัตว์ทำละเมิดต่อบุคคลที่สาม (4) ให้คิดอัตราเบี้ยประกันขึ้นอยู่กับภูมิศาสตร์ สถานที่อาศัย (5) ให้มีการทำประกันภัยภาคบังคับในสัตว์เลี้ยงโดยเพิ่มลงในพระราชบัญญัติป้องกันการทารุณกรรมและการจัดสวัสดิภาพสัตว์ พ.ศ. 2557 (6) ให้มีการกำหนดโทษของผู้ไม่ทำประกันภัยสัตว์เลี้ยงลงในพระราชบัญญัติป้องกันการทารุณกรรมและการจัดสวัสดิภาพสัตว์ พ.ศ. 2557 |
| metadata.dc.description.other-abstract: | This study involves qualitative research with the objective of: (1) investigating previous research, theoretical concepts, and current status of compulsory pet insurance laws, as well as associated issues; (2) comparing and contrasting foreign laws on compulsory pet insurance, and evaluating different approaches and measures taken by other countries; (3) analyzing legal frameworks related to pet casualty insurance; and (4) suggesting guidelines to improve and strengthen insurance measures for better enforcement in terms of appropriateness, efficiency, and effectiveness. The results suggest that Thai insurance legislation does not have a specific and detailed definition of “pet” in comparison to other countries. Additionally, it lacks clear regulations regarding pet insurance conditions, coverage, premium rate calculation, and the enforcement of compulsory insurance. Recommendations include: (1) Defining “pet” in the Prevention of Cruelty and Animal Welfare Act B.E. 2014; (2) Adopting laws from the United States; (3) Specifying details such as pet health insurance and compensation for third-party liability separately; (4) Determining premium rates based on geographical factors like place of residence; (5) Making pet insurance compulsory by integrating it into the Animal Cruelty Prevention and Welfare Act 2014; and (6) Imposing penalties on those who fail to obtain pet insurance under the Prevention of Cruelty and Animal Welfare Act 2014. |
