dc.description.abstract	งานวิจัยฉบับนี้เป็นงานวิจัยเชิงคุณภาพมีวัตถุประสงค์เพื่อศึกษา 1) เพื่อศึกษาการพัฒนากระบวนการยุติธรรมทางเลือก จัดการคดี ไกล่เกลี่ยข้อพิพาท 2) เพื่อเสนอแนวทางการพัฒนากระบวนการยุติธรรมทางเลือก การจัดการคดี ไกล่เกลี่ยข้อพิพาทด้วยระบบออนไลน์ ใช้วิธีการสัมภาษณ์เชิงลึก มีกลุ่มผู้ให้ข้อมูลรวม 40 คน แบ่งออกเป็น 2 กลุ่มคือ 1) ศาลแรงงานกลาง 2) ศาลทรัพย์สินทางปัญญาและการค้าระหว่างประเทศ แต่ละกลุ่มประกอบไปด้วย อธิบดี รองอธิบดี ผู้พิพากษาอาวุโสส่วนไกล่เกลี่ย ผู้อำนวยการ ผู้พิพากษาสมทบ ผู้ประนีประนอม หัวหน้างานส่วนไกล่เกลี่ย เจ้าหน้าที่และนิติกรประจำ การวิเคราะห์เอกสารเนื้อหา (Content Analysis) นำเสนอข้อมูลด้วยวิธีการพรรณนา และข้อมูลที่ได้จากการสัมภาษณ์ (Interview) ใช้วิธีการวิเคราะห์แบบอุปนัย(Analytic Induction) สร้างบทสรุปและการพิสูจน์บทสรุป ผลการวิจัยพบว่า 1) การนำกระบวนการยุติธรรมทางเลือก (Alternative Dispute Resolution หรือ ADR) ด้วยวิธีการไกล่เกลี่ยออนไลน์มาใช้ควบคู่กับการพิจารณาพิพากษาคดีระบบปกติ 2) เกิดพระราชบัญญัติไกล่เกลี่ยออนไลน์ พ.ศ. 2562 ขึ้นมาบังคับใช้ 3) ทำให้มีการไกล่เกลี่ยออนไลน์ทางอิเล็กทรอนิกส์ ขั้นตอนการใช้งานนวัตกรรมผ่านระบบ CIOS, E-Filing หรือ QR Code ในรูปแบบต่างๆ เช่น Line, Zoom, Google Meet เป็นต้นทำให้คู่กรณีไม่ต้องเดินทางไปศาลก่อให้เกิดความสะดวก รวดเร็ว และประหยัดค่าใช้จ่าย และทำให้ลดปริมาณคดีที่จะเข้าสู่ศาล เกิดจากการบริหารงานแบบออนไลน์ เข้าถึงกระบวนการยุติธรรมได้ตลอด 24 ชั่วโมง ด้วยบัตรประจำตัวประชาชนเพียงใบเดียวโดยไม่ต้องเดินทางมาศาล	en_US

dc.description.other-abstract	This study employed a qualitative methodology and aimed to 1) investigate the development of the alternative dispute resolution, trial management, and mediation, and 2) propose the guidelines for the development of the alternative dispute resolution, trial management, and mediation through an online platform. Data were gathered through in-depth interviews with 40 key informants from the Central Labor Court and the Intellectual Property and International Trade Court. These informants included the chief justice, deputy chief justice, senior justice of the mediation division, director, lay judge, mediator, head of the mediation division, official and attorney. This study utilized content analysis as the primary method for data analysis, presented the findings using a descriptive approach, and employed analytic induction to arrive at conclusions. The study showed that 1) the implementation of online dispute mediation was successfully executed; 2) The enactment of the Dispute Mediation Act, B.E. 2562, came into effect; 3) Dispute mediation procedures were made accessible through online systems like CIOS, E-Filing, or QR Codes, as well as on various platforms including Line, Zoom, Google Meet, and others. The integration of online platforms for dispute mediation brought about enhanced convenience, expeditiousness, and cost-effectiveness, resulting in a notable reduction in the caseload burdening the courts. Moreover, individuals could now avail themselves of the justice system around the clock, using only with their national identification card.	en_US
