| Abstract: | วิทยานิพนธ์นี้มีวัตถุประสงค์เพื่อศึกษาและเปรียบเทียบข้อกฎหมายเกี่ยวกับการครอบครอง มีและใช้อาวุธปืนของประเทศไทย ประเทศออสเตรเลีย ประเทศนอร์เวย ์ และประเทศเกาหลีใต้ อีกทั้ง วิเคราะห์ปัญหาข้อกฎหมายเกี่ยวกับการครอบครอง มีและใช้อาวุธปืนของประเทศไทยเพื่อเสนอแนว ทางการปรับปรุงแก้ไขและพัฒนากฎหมายเกี่ยวกับการครอบครอง มีและใช้อาวุธปื นของประเทศไทยให้มีประสิทธิภาพมากขึ้น ผลการศึกษาพบว่า กฎหมายเกี่ยวกับการครอบครอง มีและใช้อาวุธปืนของประเทศไทย มีปัญหา ข้อกฎหมายทั้งก่อนและหลังอนุมัติใบอนุญาต ปัญหาข้อกฎหมายก่อนอนุมัติใบอนุญาต อาทิ คำนิยาม อาวุธปืน วัตถุประสงค์การขออนุญาต คุณสมบัติผู้ขออนุญาต จำนวนอาวุธปื นที่อนุญาตให้ครอบครอง ความรู้ด้านความปลอดภัย เป็นต้น ส่วนปัญหาข้อกฎหมายหลังอนุมัติใบอนุญาต อาทิ มาตรการติดตาม ตรวจสอบการครอบครอง มีและใช้อาวุธปืน โดยเฉพาะอายุหรือระยะเวลาใบอนุญาต การติดตาม ตรวจสอบการใช้อาวุธปืนตามวัตถุประสงค์การขออนุญาต การจัดเก็บอาวุธปืนและเครื่องกระสุน และ การเพิกถอนใบอนุญาต เป็นต้น นอกจากนี้ งานวิจัยนี้ยัง ค้นพบว่า ระบบกฎหมายควบคุมอาวุธปืน มี 3 แนวทาง ได้แก่ 1) ระบบกฎหมายควบคุมอาวุธปืนอย่างเข้มงวด ซึ่งลักษณะสำคัญของกฎหมายในประเทศที่ควบคุมอาวุธปืนอย่างเข้มงวดจะไม่อนุญาตให้ประชาชนครอบครอง มีและใช้อาวุธปืนเพื่อการป้องกันตัวเองและทรัพย์สิน ระบบกฎหมายมุ่งเน้นที่ความปลอดภัย และความสงบสุขของสังคมอันเป็นประโยชน์สาธารณะมากกว่าการป้องกันตัวเองอันถือเป็นผลประโยชน์ส่วนตัว 2) ระบบกฎหมายควบคุมอาวุธปืนกึ่งเข้มงวด ซึ่งลักษณะสำคัญของกฎหมายในประเทศที่ควบคุมอาวุธปืนกึ่งเข้มงวด อนุญาตให้ประชาชนครอบครอง มีและใช้อาวุธปืนเพื่อการป้องกันตวั เองและทรัพย์สินภายใต้เงื่อนไขบางประการ ระบบกฎหมายให้ความสำคัญ ท้้งประโยชน์สาธารณะและการให้สิทธิป้องกันตนโดยชอบ 3) ระบบกฎหมายควบคุมอาวุธปืนอย่างเสรี อนุญาตให้ครอบครอง มีและใช้อาวุธปืนเพื่อป้องกันตนเองได้ |
| metadata.dc.description.other-abstract: | This independent study aims to study and compare the laws relating to possession and use of firearms in Thailand, Australia, Norway and South Korea as well as to analyze legal issues relating to possession and use of firearms in Thailand to propose guidelines for improving and developing laws relating to possession and use of firearms in Thailand more efficiently. The study found that according to laws relating to possession and use of firearms in Thailand, there are legal problems both before and after license approval. The legal problems before license approval included the definition of firearms, purpose of requesting permission, licensee's qualifications, number of firearms allowed in possession, knowledge of safety, etc. The legal problems after license approval included measures to monitor of possessing, having and using firearms especially the age or duration of the license, monitoring and inspecting the use of firearms according to the purpose of applying for a license, storage of firearms and ammunition and license revocation, etc. In addition, this research revealed that there are three approaches to the gun control legal system as follows: (1) strict gun control law system in which a key aspect of the laws in countries with strict gun control does not allow citizens to possess and use firearms for personal and property protection. The legal system is more focused on the safety and peace of society in the public interest rather than in the self-defense of private interests. (2) A semi-rigid gun control law system which is a key aspect of the laws in countries where gun control is semi-strict and the laws allow people to possess, have and use firearms for selfdefense and property protection under certain conditions. The legal system gives importance to both public interest and the right to self-defense. 3) Free gun control legal system which allows possession and use of firearms for self-defense |
