| Abstract: | วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์ 4 ประการ คือ (1) เพื่อค้นหาถึงสาเหตุ ปัญหา รูปแบบ และวิธีการของคาสิโนออนไลน์ โดยการเปรียบเทียบกับเกมออนไลน์ (2) เพื่อวิเคราะห์ถึงปัญหากฎหมายเกี่ยวกับคาสิโนออนไลน์ในประเทศไทย (3) เพื่อเปรียบเทียบหลักการและเหตุผลของกฎหมายเกี่ยวกับคาสิโนออนไลน์ในประเทศไทยกับในต่างประเทศ และ (4) เพื่อกำหนดกฎเกณฑ์ทางกฎหมายเพื่อใช้บังคับกับคาสิโนออนไลน์อย่างมีประสิทธิภาพวิทยานิพนธ์ฉบับนี้พบว่าคาสิโนออนไลน์มีลักษณะใกล้เคียงกับเกมออนไลน์มากกว่าการพนันในสถานคาสิโน ดังนั้น การนำพระราชบัญญัติการพนัน พ.ศ. 2478 (พระราชบัญญัติ) มาใช้บังคับกับคาสิโนออนไลน์จึงไม่เหมาะสม ทั้งนี้ เนื่องจาก โดยลักษณะของคาสิโนออนไลน์ การนำพระราชบัญญัติมาใช้บังคับ จึงทำได้เพียงการตีความกฎหมายฉบับนี้อย่างกว้าง เพื่อลงโทษผู้กระทำผิด ซึ่งขัดต่อหลักการตีความกฎหมายอาญาอนึ่ง กฎหมายของประเทศไทยยังไม่ได้ห้ามเกมการพนันทั้งหมดโดยเด็ดขาด เกมการพนันยังคงเล่นได้โดยมีเงื่อนไขว่ามันจะต้องถูกควบคุมโดยรัฐบาลไทยเพื่อป้องกันไม่ให้ประชาชนไทยมัวเมาในการพนัน การพนันอาจถูกจำกัดประเภทลงตามที่รัฐบาลไทยเห็นเหมาะสมเพื่อให้มีผลกระทบเชิงลบต่อประชาชนไทยน้อยที่สุดดังนั้น ผู้เขียนวิทยานิพนธ์ฉบับนี้จึงมีความเห็นว่า หากรัฐบาลไทยสามารถกำหนดกฎหมายที่เหมาะสมเพื่อควบคุมคาสิโนออนไลน์รัฐบาลไทยจะมีรายได้เพิ่มขึ้นเพื่อพัฒนาประเทศ โดยผลจากข้อสรุปนี้ ผู้เขียนวิทยานิพนธ์ฉบับนี้ จึงขอเสนอให้คาสิโนออนไลน์ได้รับอนุญาตจากรัฐบาลให้เล่นได้ การประกอบธุรกิจคาสิโนออนไลน์ตามจริงสามารถทาได้โดยใบอนุญาต รัฐบาลไทยจะต้องออกกฎหมายที่เหมาะสมเพื่อใช้ควบคุมคาสิโนออนไลน์ได้อย่างมีประสิทธิภาพ การละเมิดกฎหมายดังกล่าวจะต้องถูกลงโทษอย่างมีประสิทธิภาพ |
| metadata.dc.description.other-abstract: | This Thesis has 4 objectives, namely: (1) to find the causes, legal issues, models, and manners of playing casinos online by comparing them with games online; (2) to appraise legal issues relating to games online in Thailand; (3) to compare the principles and rationales of casinos online in Thailand and in foreign countries; and (4) to provide legal rules to effectively govern casinos online. This Thesis finds that casinos online is similar to games online rather than betting in traditional casinos. Consequently, the Thai Bet Act B.E. 2478 (Act), which is a criminal act, is not appropriate to be applied to casinos online. The reason for this is that, by the very nature of casinos online, the Bet Act can be applicable to it solely by means of liberal interpretation of the Act to penalize a wrongdoer, the interpretation of which is contrary to the rule of interpretation of criminal law. Moreover, the laws in Thailand do not absolutely prohibit betting games. They can be played provided that they are controlled by the Thai Government in order prevent the Thai citizens from imbuing with betting. They may be limited in kinds as the Thai Government sees fit in order to make them producing least negative effects to the Thai people. Therefore, the author of this Thesis considers that if the Thai Government can provide appropriate laws to control casinos online, the Thai Government can receive more revenue to develop the country. In light of this conclusion, the author of this Thesis would like to propose that the casinos online be permissible by the Thai Government. The actual business operation of casinos online can be done via licenses. The Thai Government shall enact appropriate laws to control them. The violations of the laws shall be penalized in effective manners. |
