| Abstract: | การศึกษา “การพัฒนานโยบายการใช้เรือนจำเอกชน” เป็นการศึกษาเชิงคุณภาพ (Qualitative Research) โดยใช้วิธีการเก็บรวบรวมข้อมูล คือ การศึกษาข้อมูลจากเอกสาร(Documentary Research) การสนทนากลุ่ม (Focus Group) และการสัมภาษณ์เชิงลึก (In–depth Interviews) โดยมีวัตถุประสงค์การศึกษา คือ เพื่อทราบสภาพปัญหาผู้ต้องขังล้นเรือนจำในประเทศ ไทย เพื่อทราบรูปแบบเรือนจำเอกชนที่เหมาะสมกับประเทศไทย และเพื่อจัดทำข้อเสนอเชิง นโยบายในการใช้เรือนจำเอกชนในการแก้ไขปัญหาผู้ต้องขังล้นเรือนจำผลการศึกษา ทราบถึงสภาพปัญหาผู้ต้องขังล้นเรือนจำในประเทศไทย ทราบถึงรูปแบบของเรือนจำที่เหมาะสมกับประเทศไทย (รูปแบบที่รัฐจ้างเหมาในกิจการบางอย่างและรูปแบบที่รัฐให้เอกชนบริหารจัดการทั้งหมด) ทั้งนี้ การใช้เรือนจำเอกชนในการแก้ไขปัญหาผู้ต้องขังล้นเรือนจำควรถูกขับเคลื่อนในเชิงนโยบายระดับประเทศ และควรให้ความสำคัญกับประเด็นปัญหาอื่นๆ ที่ควรแก้ไขและเสนอเป็นข้อเสนอเชิงนโยบายในประเด็นอื่นๆ ด้วยข้อเสนอแนะที่ได้จากการวิจัย ได้แก่ ควรให้ความสำคัญกับการลดจำนวนผู้กระทำความผิดเข้าสู่เรือนจำและลดการบังคับโทษจำคุกในกระบวนการยุติธรรมและศึกษาหาแนวทางในการ พิจารณาพิพากษาของศาลที่ควรพิจารณามาตรการลงโทษทางเลือกแทนการจำคุกให้มากขึ้น |
| metadata.dc.description.other-abstract: | The study of the development of the private prison policy is a qualitative research by using the data collection method which is Documentary Research Focus Group and In-depth Interview. The research objectives are to study the problems of prison overcrowding in Thailand; to study the private prison model that is suitable for Thailand; and to formulate a policy proposal for the use of private prison to solve the problems of overflowing inmates. The results of the study revealed the awareness of the problems of prison overcrowding in Thailand. Moreover, it was found that the models of private prison are suitable for Thailand. For example, the state hires a contract in some aspects, and the state allows the private sector to manage all aspects of administration. The use of private prisons to solve the problem of prison overcrowding should be driven by a national policy and focus on other issues that should be solved and proposed as a policy proposal on other issues as well. The recommendations obtained from the research include focusing on reducing the number of prisoners, reducing the use of imprisonment in the judicial process and studying the approach to court rulings in which alternative punishment instead of imprisonment should be considered more. |
