| Abstract: | การวิจัยนี้มีวัตถุประสงค์ที่สำคัญในการวิจัยปัญหาต่างๆ เกี่ยวกับการบังคับใช้กฎหมายประกันสังคมต่อแรงงานนอกระบบในประเทศไทย โดยศึกษาถึงการขยายความคุ้มครองการประกันสังคม รูปแบบการจัดการประกันสังคมที่มีต่อแรงงานนอกระบบของต่างประเทศและศึกษาถึงสภาพปัญหาการบังคับใช้กฎหมายต่อแรงงานนอกระบบของไทยตามพระราชบัญญัติประกันสังคม พ.ศ. 2533 มาตรา 40 และกฎหมายที่เกี่ยวข้อง รวมถึงการเสนอแนะแนวทางพัฒนาปรับปรุงกฎหมายประกันสังคมในการคุ้มครองแรงงานนอกระบบให้มีความเป็นธรรมมากยิ่งขึ้นโดยใช้วิธีดำเนินการวิจัยเอกสารหลักฐานต่างๆ จากการรวบรวมข้อมูลที่เกี่ยวข้องจากหนังสือวิทยานิพนธ์ บทความ วารสารต่าง ๆ ที่เกี่ยวกับแรงงานนอกระบบทั้งของไทยและต่างประเทศผลการวิจัยพบว่า แรงงานนอกระบบของไทยยังไม่ได้รับความคุ้มครองจากกฎหมายอย่างทั่วถึงและเป็นธรรม ได้รับค่าตอบแทนที่ไม่เป็นธรรมและไม่แน่นอน การทำงานไม่ต่อเนื่องสม่ำเสมอ มีปัญหาสุขภาพและการทำงานที่ไม่ปลอดภัย ดังนั้น ผู้วิจัยจึงเสนอแนะให้มีการจัดทำพระราชบัญญัติที่ออกมารองรับแรงงานนอกระบบตามมาตรา 40 ให้รัดกุม เหมาะสม และเป็นธรรมต่อแรงงานนอกระบบและเป็นประโยชน์ต่อสังคมไทยมากที่สุด โดยให้ทราบข้อมูลทางสถิติต่าง ๆ ว่ามีแรงงานนอกระบบทั้งหมดกี่ประเภท มีรายได้อย่างไร เหมาะสมกับการดำรงชีพในปัจจุบันหรือไม่ และการสร้างทางเลือกในการจ่ายเงินสมทบเข้ากองทุนของแรงงานนอกระบบให้เหมาะสมกับความเป็นจริงของแต่ละอาชีพที่มีกำลังจ่ายอาจต่างกัน เช่น อาจเป็นราย 3 หรือ 6 เดือนทั้งนี้เพื่อให้แรงงานนอกระบบสามารถบริหารจัดการตามความเหมาะสมไม่เดือดร้อนและได้รับความคุ้มครองตามพระราชบัญญัติประกันสังคม พ.ศ. 2533 มาตรา 40 อย่างแท้จริง |
| metadata.dc.description.other-abstract: | This research has objective to analyze problems on law’s enforcement of social security system for informal workers in Thailand by learning of expanse of protection to get privilege from social security system and learning of problem laws enforcement under social security act 1990 Section40 and related laws, as well as the recommendation to develop social security laws in order to protect informal workers to get privilege more equitable. The study applied a documentary research by the process of document’s collection from book, thesis, article and journal for learning about informal workers system in other countries. The results of research, most of informal workers in Thailand, they didn’t get equitable protection from laws because they have low salary and they have low knowledge to understand and learn about it. The research focus on improvement of section 40, so that informal workers will have more and appropriate protection by collect document include statistic, type of labor, salary and relationship with life style cost. We try to arrange more appropriate contribution to the support fund relating with their salary and their job such as plan for collect money in every 3 months, every 6 months. Consequently, they could enjoy protection under social security laws including section 40 more effectively. |
